COPPERAS COVE — The City Council on Tuesday approved a resolution allowing a developer to start selling land in phase 1 of the 229-residental-lot Heartwood Park.
The resolution “clarifies there are lots that have been removed from the final plat,” said Chris Stewart, of Stewart Planning Consulting, the city’s planner. “Those lots are in the floodplain and can’t be sold.”
After the council’s action, the resolution will be attached to the final plat as it is recorded by the county so the lots’ position in the flood plain will be recorded, Stewart said to the council.
Councilman Jim Schmitz and Mayor Pro-tem Frank Seffrood expressed concern about the lots’ upkeep after the subdivision’s build-out.
City Manager Andrea Gardner said the developer will retain responsibility for the lots and code compliance officers can ensure the developer complies.
The city approved the final plat for the first phase of the development in June before it realized requirements on the lots in the floodplain weren’t complete, stated city documents.
By holding off on the plat recording, the developer couldn’t sell lots in the subdivision until the issue with the floodplain lots was resolved. Gardner said the developer did work in the area of the floodplain and must restore it to its natural state.
At its build-out, Heartwood Park was originally proposed for more than 770 lots on 224 acres off Courtney Lane. The first phase is 62 acres.
