COPPERAS COVE — An administrative error caused the city council to delay action on re-subdividing an area of the Five Hills shopping center and approving a final plat for a residential subdivision Tuesday.
According to the city’s ordinance, certain procedures have to be followed when handling replats and final plats, said Erin Higginbotham, a representative with the city’s Austin-based law firm, Denton, Navarro, Rocha & Bernal PC. For two of Tuesday’s agenda items, the city did not follow those policies for conducting public hearings such as posting proper notice.
Among the two issues was resubdivision of the first lot of the Five Hills shopping center into four lots for future pads sites. The property is being developed by Austin-based Endeavor Real Estate, and two strip buildings and an H-E-B store are being constructed.
Daniel Campbell, a development associate with the Austin firm, said the request for the resubdivision was made to continue with the development of the property and start leasing some space in the retail center. Delaying actions by two weeks to provide proper notice to residents could affect the property, he said.
“We have prospective tenants for these pad sites, and they are trying to get in for permits for construction,” said Campbell. “Delaying two weeks will delay them two weeks.”
He said that such a measure was being taken by the developer so the tenants would know what properties were theirs to lease and could hire attorneys, architects and engineers to start the process of locating to Copperas Cove.
The second issue delayed by the administrative mistake is the final platting of the Skyline Flats subdivision phase 2, section 3.
Having previously approved the action, before the error was caught, the council rescinded its decision and delayed it until Tuesday.
Trying to find a middle ground between waiting two weeks and acting within the city’s regulations, the council agreed to hold a special meeting at 5 p.m. Tuesday to readdress the issue.
Action taken by the council included:
Denying changes to the city’s future land use plan.
Denying the rezoning of eight lots at 802 W. Avenue B to a business district from a residential district.
Appointing members to the Copperas Cove Hospital Authority Board.
Approving a water purchase construct with Cedar Grove Mobile Home Park.
