A Killeen man accused of abandoning his 4-year-old at a child care facility in November was indicted Wednesday by a Bell County grand jury on a charge of assault of a public servant.

Antonio Heath Jr., 27, was arrested Nov. 16 at his apartment in the 600 block of West Hallmark Avenue. The offense is a third-degree felony punishable by up to 10 years in prison.

While police tried to arrest him, Heath kneed the officer in the groin area, according to the affidavit for arrest. The officer was taken by ambulance to Seton Medical Center in Harker Heights, and was treated and released.

Police went to Heath's apartment after responding to a call in the 1200 block of South W.S. Young Drive in which a man dropped off his 4-year-old daughter at the facility, said he didn’t want her anymore and left, according to a news release. The child did not attend the facility, and the employees of the day care did not know the man.

The child was in the custody of a family member, according to Killeen police spokesman Cmdr. Erich Morsbach.
