Local day care provider Any Time Child Care is being sued for a company bus driver's role in a Sept. 23 crash that sent seven children to area hospitals.

The company, which operates four day cares in Killeen, Copperas Cove and Temple, is being sued by the other driver involved in the collision, Jeffrey D. Peters.

Day care bus driver Heather Dickinson, 23, operated the day care's bus without a commercial driver's license, something that was known to Any Time Day Care officials at the time of the accident, according to a crash report.

Company representative Abraham Nimeh said he was not aware of the lawsuit when first contacted by the Daily Herald. After reviewing the lawsuit, he did not comment.

"At this point, I can't make a comment about legal matters," he said.

Peters' attorney, Ryan L. Thompson, said he has not specified the amount of monetary damages his client is seeking from Any Time Child Care.

Thompson said Peters, 37, sustained injuries to his head, neck and shoulders. As a result of the accident, he was taken to Carl R. Darnall Army Medical Center at Fort Hood.

A statement from an adult passenger in the bus indicated Dickinson was a newly hired bus driver.

Dickinson had been dropping off children at school when she failed to yield the right-of-way while pulling onto Farm-to-Market 3470 from Lonesome Dove Drive in Killeen.

Dickinson pulled in front of Peters' blue Ford Expedition as it was headed west on FM 3470.

Peters' SUV struck the bus near the driver's-side door. The driver then lost control of the bus, which crossed the eastbound lanes of FM 3470, went into a ditch and came to rest after crashing into a fence.

One other vehicle sustained minor damages in the crash from debris, the report states.

The lawsuit accuses Any Time Child Care of being negligent in the hiring and employment of Dickinson. Peters seeks compensation for medical expenses, pain and suffering, mental anguish and loss of wages.

Thompson said he filed the suit as a result of Any Time Child Care providing a complete copy of its insurance policies. Nimeh said he had provided Thompson the company's liability policy.
