The man who police said shot a 12-year-old boy and his father after a child custody dispute was indicted by a Bell County grand jury Wednesday.

Earlie Bernard Marsh, 31, is charged with aggravated assault resulting in bodily injury with a deadly weapon. He was assigned a $70,000 bond and held in the Bell County Jail, but has since been released.

Killeen police responded to a call about a disturbance in the 500 block of North Eighth Street at about 11:15 p.m. on Nov. 21. Upon arrival, officers were told the people involved could possibly be in the 1500 block of North College Street.

A Mini Cooper that matched the description of a vehicle police were looking for was at the scene when police officers arrived, and a 33-year-old man and his four children were inside, police said.

The man was shot through the windshield of the car by Marsh, who is the fiancé of the childrens’ mother, Killeen police spokesman Cmdr. Erich Morsbach said in November. He was found with a gunshot wound to the abdomen.

The 12-year-old was in the passenger seat of the car with a gunshot wound above his knee, which he suffered outside of the car, according to Morsbach.

He was brought to the Carl R. Darnall Army Medical Center. The injury was not life-threatening. The three children in the back of the car were unharmed.

Indicted in unrelated incidents Wednesday were:

Irving Torres, 53, of Killeen on a charge of indecency with a child by sexual contact.

Maria Lucinda Guajardo, 35, of Killeen on a charge of credit card abuse.

Shelby DeJuan Doolittle, 30, of Killeen on a charge of evading arrest with a vehicle.

Marquell Tremont Betters, 22, of Waco on a charge of evading arrest with a vehicle. He was charged as a repeat offender.

Archie Francisco Bonilla-Santiago, 22, of Killeen on a charge of unauthorized use of a vehicle.

James Ralph McMillen III, 45, of Killeen on a charge of unauthorized use of a vehicle. 

Kizzie Michelle Malave, 40 of Harker Heights on a charge of delivery of a controlled substance 4 grams or more.

Teresa A. Conery, 48, of Belton on a charge of possession of a controlled substance 1 gram or more.

Gregory Peter Manibusan, 61, of Killeen on a charge of possession of a controlled substance 4 grams or more.

Rodolfo Angeles Zuviri, 25, or Killeen on a charge of possession of a controlled substance less than 1 gram. Sarah Elizabeth Day, 27, of Killeen on a charge of possession of a controlled substance less than 1 gram.

George Travis Williams, 55, of Killeen on a charge of possession of a controlled substance less than 1 gram.

David Joseph Evans, 47, of Harker Heights on a charge of possession of a controlled substance less than 1 gram.

Jene Mabry, 21, of Clarksdale, Mississippi on a charge of possession of marijuana 5 pounds or less.
