A former employee dropped her lawsuit against the city of Killeen for allegedly violating a 2009 settlement agreement.
Austin attorney Bill Aleshire filed a notice of nonsuit in Bell County’s 169th District Court on Tuesday on behalf of his client, former Killeen recreation superintendent Megian Douglass.
Douglass filed the lawsuit against the city Sept. 6, claiming the city failed to abide by the terms of a 2009 settlement agreement with Douglass, telling prospective employers that she was “terminated” by the city — instead of stating that she resigned.
Douglass filed the suit after recording a call in which the city’s Human Resources Department confirmed that she was listed as “terminated” in its records. City Attorney Kathy Davis said the records showed Douglass’ status as “terminated — personal,” which meant she resigned.
“The HR employee who answered this phone call had all of the necessary information available, and knew what it meant, but did not properly convey it,” Davis wrote in a Sept. 11 email to Aleshire. “It appears that she might not have consulted the second screen that gives the reason for leaving. That has been addressed with all employees who are in a position to provide this information in the future.”
On Wednesday, Killeen spokeswoman Hilary Shine said the actual terminology used by the human resources system will not change.
The notice Aleshire filed with the court this week was filed “without prejudice,” meaning Douglass’ claim can be renewed if the city fails to comply with the agreement in the future.
“Based on the experience we’ve had with the current administration at the city, we are guardedly optimistic that they will comply,” Aleshire said.
