BELTON - A Bell County grand jury on Wednesday returned an indictment against a Killeen man on three counts of sexual assault.
Luis Amed Bustamante, 29, was charged with sexual assault in connection with a Jan. 11 incident in which he allegedly raped his neighbor, a 19-year-old woman.
An arrest report states Bustamante knocked on the woman's door at an apartment complex in the 2800 block of Tucker Drive. When she answered, Bustamante grabbed her and forced her into his apartment.
Bustamante then allegedly forced himself upon the woman. The three separate counts of sexual assault stem from different sexual acts that occurred during the same incident, according to the indictment.
The woman managed to get away from Bustamante and ran into her home. She left behind a pair of underwear police later found outside directly under Bustamante's apartment window.
The alleged victim's roommate told police she heard the woman yell, "No!" before the woman came running into the apartment. The alleged victim told her she had just been raped.
When contacted by police, Bustamante appeared nervous. First he denied anything sexual happened between him and the woman. He later told police the two had engaged in a consensual sexual act.
When asked about the woman's underwear, Bustamante told police he threw them out the window when he saw police arrive.
A sexual assault exam indicated the woman had suffered physical trauma associated with a rape.
Bustamante was not in Bell County Jail Wednesday night.
