Heights couple to pay $430K to settle medical fraud

HARKER HEIGHTS — A Harker Heights doctor and her husband agreed to pay $430,000 in a civil settlement for allegedly defrauding the military’s health care program.

Dr. Bola Elemuren and her husband, John Ogunmuyiwa, were accused of over billing Tricare for laboratory tests performed along with billing it, Medicare and Medicaid for X-rays performed by unqualified and improperly trained employees, according to the U.S. Attorney’s Office.

Elemuren and Ogunmuyiwa own Family Medicine Clinic on South Amy Lane in Harker Heights. Elemuren is a general practitioner who also sees patients at other offices in Bell County.

Attempts to reach the couple were unsuccessful Thursday.

The settlement is not an admission of guilt, said U.S. Attorney’s Office spokesman Daryl Fields. The couple agreed to pay the settlement prior to any litigation being filed.

The couple overcharged the government by purposely mislabeling laboratory tests to diagnose vaginitis and bacterial vaginosis, a news release stated.

Under government rules, the laboratory tests should have been bundled into a single item to invoice. Elemuren and Ogunmuyiwa would instead turn the single test into multiple charges, Fields said. The alleged overbilling took place from 2003 to 2008.

The improper X-rays took place from 2008 to 2012, Fields said.

    Then what else would it be called if not an admission of guilt ?
    A professional such as this, along with the words, overcharged and purposely mislabeling in article,And then along with an agreement to pay a settlement ?
    Even an uneducated person who could put two and two together,would have to believe, it was indeed done intentionally.
    I hope its a fast repayment of the $430 K so it can be gotten back into the tax payers kitty,They are told they are low on money and need all funds,that shouldn't have been paid to people who were not suppose to have it.
