Heights postpones Lynn Drive demolition

HARKER HEIGHTS — The city agreed to postpone the demolition of 19 Lynn Drive houses for 30 days to allow the owner, David Buttross, to submit an adequate comprehensive plan to bring the vacant structures up to health and safety standards, City Attorney Burk Roberts said Friday.

The agreement came 15 minutes before a scheduled hearing on a temporary restraining order and injunction application Buttross filed against the city in January. In light of the temporary settlement between Buttross and the city, the hearing was canceled.

“The owner’s council requested 30 days and (the city) agreed to that,” Roberts said.

In the past, Buttross has maintained that he submitted rehabilitation plans that were either lost or rejected by the city.

Planning and Development Director Fred Morris disagreed.

“All they have done to date, on two occasions, is simply do a property assessment,” Morris said Friday. “We’re looking for a set of plans that we issue permits on … they haven’t given us what we have to have to issue building permits that comply with the 2009 international codes.”

The city has worked with Buttross for about a year to get the Lynn Drive properties rehabilitated, after building officials deemed them unsafe and hazardous structures. Demolition was ordered in December after Buttross failed to bring the houses up to code in the agreed upon time frame, according to the city.
