Killeen man indicted on injury to a child charge

BELTON - A Bell County grand jury Wednesday indicted a 23-year-old Killeen man accused of shaking a 19-month-old child.

Charges of injury to a child with bodily injury, a second-degree felony, will move forward against Brian Keith Powell. If convicted, Powell could face up to 20 years in prison.

Police arrested Powell Aug. 3, two days after receiving a report from staff at Metroplex Hospital of possible child abuse. According to court documents, police responded to the hospital on Aug. 1 and spoke with staff.

A doctor told police he examined a 19-month-old boy with internal bleeding on his brain and damage to his eye. The doctor characterized the injuries as consistent with "Shaken Baby Syndrome," court documents stated.

Police met with Powell, who said he had been watching the children at a home in the 400 block of West Avenue C when the injury occurred.

Powell initially told police he checked on the child and found him shaking and struggling to breathe. He then called emergency personnel, an arrest affidavit states.

After police notified Powell that he was being arrested on suspicion of causing the injuries, Powell admitted to shaking the child because the boy would not stop crying.

Powell said he panicked and called 911 after he realized the child stopped breathing, the affidavit states.

The grand jury also returned indictments against the following:

Darin Duane Drummond, 35, of Temple, on a charge of assault on a public servant. Drummond is accused of attempting to gouge out a Temple police officer's eye during a Sept. 24 altercation.

Brandon Seawood, 24, of Killeen, on a charge of possession of cocaine, 1 gram or more.

David Gaylord Wall II, 18, of Temple, on a charge of tampering with physical evidence.

Jeremy Eugene Brown, 24, of Belton, on a charge of injury to a child.

Jose Francisco Gutierrez, 24, of Belton, on a charge of burglary of a habitation.

Bo Gutierrez, 22, of Belton, on a charge of burglary of a habitation.

Kameron Wade Daugherty, 22, of Temple, on a charge of burglary of a building.

Devin L. Johnson, 21, of Temple, on a charge of burglary of a building.

Crystal Michelle Conners, 26, of Temple, on a charge of credit card abuse.

Timothy James Rice, 33, of Temple, on a charge of driving while intoxicated with a child passenger.

Martin Danny Simmons, 56, of Temple, on a charge of theft of metal.

Edward Gandara, 25, of Temple, on a charge of evading arrest with a motor vehicle.

Rusheam Rayshon Jaquan, 39, of Temple, on a charge of aggravated assault with a deadly weapon.

Clifford Hampton Mayo, 44, of Killeen, on a charge of failure to comply with registration requirements.

Nicholas Edwin Lowell, 22, of Killeen, on a charge of injury to a child.

Maxwell Scott Perkins, 21, of Killeen, on a charge of burglary of a habitation.

Joshua Cornelius Hayes, 17, of Killeen, on a charge of burglary of a habitation with intent to commit theft.

Matthew Dean Miller, 22, of Killeen, on a charge of burglary of a habitation.

Donna Kay Bufford, 33, of Killeen, on a charge of aggravated robbery,

Harold Davis, 42, of Killeen, on a charge of possession of cocaine, less than 1 gram.
