Killer going to prison for life

BELTON – A 27-year-old Killeen man was sentenced Tuesday to life in prison for the murder of Anthony Hemingway with a handgun in Hemingway's Killeen apartment in August 2007.

Though his trial was scheduled for Monday in Martha Trudo's 264th Judicial District Court, Christopher Ray Smith pleaded guilty in her court Tuesday to first-degree murder and burglary with intent to commit assault. Trudo also sentenced Smith to 30 years for the burglary charge, to run concurrently.

On Aug. 20, 2007, officers responded to a call from Hemingway's teenage son that shots were fired at the family's apartment at 6:30 a.m. in the 1500 block of Windward Drive.

Police found the back door kicked in and Smith lying in the hallway.

According to Herald archives, Smith broke into Hemmingway's apartment and robbed him at gunpoint. Hemmingway grabbed his own gun and fired at Smith in self-defense. Smith returned fire, hitting Hemmingway with multiple shots.

Hemmingway's body was found in the master bedroom with a gun underneath it, according to the arrest affidavit. He died from five gunshot wounds to the chest.

Police found Hemmingway's cell phone and wallet in Smith's pocket.
