Murder charge dropped against man

GATESVILLE — A murder charge against Jeremy Thomas Fitzgerald, 28, of Gatesville was dismissed by a special state prosecutor who determined Fitzgerald acted in self-defense in the shooting death of Adam Wade Ruffin last year, Coryell County District Attorney Dusty Boyd said Tuesday.

The trial was set to begin Tuesday.

Boyd, who took office in January, said he asked the state special prosecutions unit to handle the case because of a conflict of interest.

Boyd, formerly an assistant county attorney, said he had a conflict of interest in the case because he had prosecuted Ruffin twice previously.

Ruffin, 29, died May 27, at Coryell Memorial Hospital after he was shot outside a mobile home in Gatesville, according to police reports.

The two men had been at a bar and later went to Fitzgerald’s trailer, where they began to fight, police reported.

Fitzgerald was indicted in August on a charge of murder.

The special prosecutor dismissed the case on the basis of self-defense and defense of a third party, Boyd said.

The dismissal was “without prejudice,” meaning the case can be refiled if new evidence is uncovered, he said.
