Nolanville mayor to get new lawyer

BELTON — Nolanville Mayor Charlie Lee Stewart was back in court Tuesday to remove his attorney from his criminal case.

Stewart, 58, has remained in Bell County Jail since he was arrested July 20 on a charge of aggravated sexual assault of a child. He is accused of raping a 12-year-old girl several times during the summer of 2011.

On Tuesday, 264th District Court Judge Martha Trudo granted a request from Stewart’s former attorney Ed Brown to withdraw from the case. Brown said his leaving the case was mutual.

“We both agreed for both of us to go our separate ways,” he said.

Brown’s withdrawal comes after the Belton attorney failed to win a reduced bail for Stewart, whose bail remains set at $500,000.

During a special hearing seeking a lesser bail amount, a Nolanville officer testified that more allegations of sexual assault had been made against Stewart.

In his motion, Brown also erroneously stated that Stewart was not arrested in Mississippi on a sexual charge. It came out in court that Stewart was arrested in 1991 on a charge of sexual battery in Natchez, Miss., that was later downgraded to misdemeanor child fondling.

Killeen attorney Gregory Simmons is expected to take over Stewart’s case, though Simmons has not filed any paperwork. His office would not confirm or deny his involvement in the case.

Stewart is a former employee of Killeen Independent School District. He resigned from a position as a technology support specialist at Manor Middle School shortly after his arrest.

Stewart is still the current Nolanville mayor. He has not contacted any city staff or given any notice of his intentions, City Manager Stephen Pearl said.

The council could remove Stewart from his post at its next meeting on Sept. 6. Nolanville’s city charter states that any elected official who has unexcused absences to three consequetive council meetings can be disqualified from office.
