BELTON — The city of Killeen presented its request in court Friday to have a lawsuit lodged by a former city finance director dismissed.

The case went before Bell County 146th District Court Judge Jack Jones.

Roy Barrett, the attorney representing the city, asked that the case be dismissed because the plaintiff, Barbara Gonzales, failed to prove reports filed against the city manager alleging violations of finance laws during her tenure at the city were the cause of her termination.

Jones had not ruled on the city’s request as of Friday evening.

Gonzales, who was fired in December 2012, sued the city in March 2013 under the Texas Whistleblower Act. In her lawsuit, she claims she was fired for reporting violations of state and local finance laws by Killeen City Manager Glenn Morrison. She is seeking between $200,000 and $1 million in compensatory damages from the city.

Todd Kelly, Gonzales’ attorney, said she was fired because Morrison “knew that she was on to him.”

The city denies claims that the reports caused Gonzales’ termination, and states that she was fired as a result of an internal investigation into the city’s Fleet Services Division, which Gonzales oversaw.

Gonzales was terminated following a two-month internal investigation of the division.

Barrett told the court Gonzales had been filing reports against Morrison “for years” without being relieved of her duties with the city. He went on to say the internal investigation showed loss of city property and mismanagement of the department by Gonzales.
