BELTON – State prosecutors reduced a Corsicana man's charge from indecency with a child by contact to public lewdness Monday.
Judge Joe Carroll of the 27th District Court sentenced Benigno David Gonzales, 21, to two years probation for committing the class A misdemeanor on Nov. 6, 2007.
The state also dropped an indecent exposure charge against Gonzales in connection with the same incident.
A Harker Heights High School student reported that during her lunch break on the day of the incident, Gonzales met her at the school and together they went to the Sonic restaurant on Indian Trail in Harker Heights, according to the arrest affidavit.
The student reported that she and Gonzales engaged in sexual activity in the parking lot at Sonic, according to the affidavit. She was 15 at the time; Gonzales was 20.
The student also reported that Gonzales gave her a cell phone to use in order for him to contact her.
In other court action, Judge Fancy Jezek of the 426th District Court sentenced Brandon Alexander Calloway, 25, of Temple, to eight years probation and 180 days in county jail for possession of marijuana, between 5 and 50 pounds, on Sept. 25.
